How much can businesses be fined for not having the right First Aid?

Every Australian business, no matter the size or industry, is legally required to provide adequate first aid facilities, equipment, and trained personnel.

Businesses in Australian states (excluding Victoria, which follows its own Occupational Health and Safety Act) can face significant fines for failing to provide proper first aid facilities and trained personnel on site. The maximum penalties depend on the severity of the breach and the type of offender (individual, officer, or body corporate).

For serious breaches under the model Work Health and Safety (WHS) laws, which are adopted by most Australian states and territories, the maximum penalties for a body corporate (i.e., business) can be as high as $11.56 million for a category 1 offence (reckless conduct exposing someone to death or serious injury/illness), $2.32 million for a category 2 offence (failure to comply with a duty exposing someone to risk of death or serious injury/illness), and $776,000 for a category 3 offence (failure to comply with a duty).

Understanding the Penalties for First Aid Non-Compliance

Under the Model Work Health and Safety (WHS) laws, which most Australian states and territories follow, businesses face strict penalties for not having the right first aid in place. Here’s what’s at stake:

Offfence type

Explanation of Offence Penalties

Category 1 Offence Reckless Conduct

Applies to conduct with gross negligence or recklessness that exposes someone to death or serious injury or illness

  • Body corporate: Up to $11.56 million
  • Individuals (officers): Up to $2.31 million
  • Individuals (other): Up to $1.16 million

Category 2 Offence Exposing to Risk

Applies to failing to comply with a health and safety duty that exposes a person to risk of death or serious injury or illness.

  • Body corporate: Up to $2.32 million
  • Individuals (officers): Up to $464,000
  • Individuals (other): Up to $232,000

Category 3 Offence   Failure to Comply

Applies to simply failing to comply with a health and safety duty — the most common for first aid non-compliance

  • Body corporate: Up to $776,000
  • Individuals (officers): Up to $155,000
  • Individuals (other): Up to $78,000

Note: Penalties may vary by state or territory, and Victoria has its own penalty structure under the OHS Act. Always check the specific legislation for your jurisdiction.

There are also lower-tier fines for less severe breaches, but even these can be substantial for small businesses, ranging from $9,400 for minor offences up to $771,000 for more significant non-compliance.

Small Mistakes, Big Consequences

Here are some of the most common first aid compliance oversights that can trigger fines:

  • Outdated or Expired Supplies: First aid kits must be regularly checked and restocked. Expired or contaminated items can render a kit non-compliant and put employees at risk.
  • Inaccessible or Unidentifiable Kits: Kits must be easy to find and access in an emergency. Clear signage is essential.
  • Inadequate Number of Kits or Trained First Aiders: The number of kits and trained personnel required depends on workplace size, hazards, and location. A risk assessment is needed to determine your needs.
  • Poor Maintenance: Infrequent checks and restocking, or improper storage, can lead to depleted or ineffective kits.

How to Avoid First Aid Fines

To stay compliant and avoid hefty penalties, businesses should:

  • Conduct a First Aid Risk Assessment: Identify potential hazards and determine the appropriate number and type of first aid kits and trained personnel.
  • Regularly Inspect and Restock Kits: Check kits monthly and replace any used or expired items.
  • Ensure Kits Are Accessible and Clearly Marked: Place kits in visible locations and use clear signage - we recommend this 3D First Aid wall sign.
  • Provide First Aid Training: Ensure staff are trained and confident to act in an emergency.
  • Keep Records: Document all inspections, restocks, and training sessions.
